Double decker overturning in a bus accident is unusual

Buses are one of the safest forms of transport in the UK with few passenger injuries or deaths and on the occasions there is a bus accident it is usually in the news because of its rarity.

When a double decker in London's Clapham was in collision with a lorry causing it to topple on its side and three passengers and the driver were injured, there were headlines and dramatic pictures in the newspapers in December 2009.

The casualties will be a rare addition to the statistics for road accident victims because buses and coaches have an accident rate which is as low as rail deaths and injuries.

For example, in 2008, there were only six deaths and 426 injuries, a drop of 50% and 4% respectively on the figures for the previous year. In the same period, fatalities among car users were 1,257, with 10,711 people injured.

Although still unusual, injuries while travelling on public transport are more likely than fatalities, with personal injury sometimes caused by circumstances such as falls if the bus driver brakes unexpectedly when passengers are standing or the vehicle moves off before everyone is safely seated or holding on tightly.

Bus drivers are professionally trained and most are extremely careful of passenger safety but if someone is hurt through negligence or inaction by the man or woman at the wheel, then it may be possible to pursue a compensation claim against the bus company's insurers.

In a bus crash with a car or other vehicle, such as the lorry in the Clapham accident, if the police prove that it was caused by one or more other drivers then a case for damages could be pursued against them rather than the bus company.

A specialist personal injury compensation solicitor will be able to advise on the best means to achieve recompense for any pain, suffering or loss of income you or a loved one have suffered as a result of a bus accident.
