Bus accident compensation and the Routemaster question

After Boris Johnson won the London Mayoral election he announced that he would look to revive that once iconic London institution, the Routemaster bus. However, as the Routemaster, with its open platform rear was something of an injury hazard, what impact would its reintroduction have on the rate of bus accident compensation claims?

Following the death knell that was sounded for the Routemaster in 2005, on not inconsiderable health and safety grounds, many nostalgic Brits convened to bemoan its loss.

However, following the intervention of Boris Johnson, it became apparent that they would only have to wait until 2012 until the Routemaster, albeit in a more modern incarnation, was again weaving its way through the streets of London.

This immediately provoked concerns that it could also herald a rise in health and safety incidents of the type Transport for London could then be held liable for payments of bus accident compensation.

For example, former Mayor Ken Livingstone once said that he believed as many as 10 people died each year as a result of getting on and getting off the Routemaster open platform.

Despite this assertion, the facts are not clear: between 2005 and 2008 two Routemaster buses remained operational on so-called "Heritage Routes", during which time 1,300,000 passengers were ferried, with only two suffering passenger injuries that required medical treatment.

There are also concerns that a new Routemaster bus would no longer be appropriate for the capital's traffic conditions. There are now many more cyclists in London than there were in the heyday of the Routemaster and many road safety experts fear that they would struggle to adapt to a bus which could have passengers using from the rear platform in an unpredictable way.

As cyclists share bus lanes and frequently overtake buses on the inside, it is possible that there could be a huge rise in the number of bus user-cyclist collisions.
