No win no fee compensation claim for pedestrians

In many cases of accident victims who are making a no win no fee compensation claim, the weaker of the two parties involved is the one suffering more severely and, therefore, the one with greater cause of complaint such as a pedestrian involved in a car accident.

A cyclist will come off worse in a collision with a motor bike, a moped rider is vulnerable in a road traffic accident with a taxi and a car driver or passenger is likely to be hurt when in a crash with a lorry or bus.

There is no simple answer on how to avoid vehicle accidents occurring, because they have many different causes, but in a large proportion of instances human error is at the root of a chain of circumstances resulting in pain of some description for one or more people involved.

People have a pretty strong survival instinct and this can save them from injury or death. They also have to recognise that as well as a duty of care to others, they are also obliged to look after their own safety, especially when interacting with others.

Walkers can be at great risk of a large and heavy vehicle colliding with them, such as when they are crossing a road, but pedestrians themselves need to ensure they are not increasing the risk of an incident through their own actions or inactions.

The Highway Code has 35 rules aimed at keeping pedestrians safe and, although most of the guidance is common sense, sometimes people forget about best practice or, especially in the case of children, have never been taught the correct way to behave around traffic.

One of the important pieces of advice refers to roads where there is no pavement and walkers will have to be alongside traffic. In those instances, they should walk on the right side facing oncoming vehicles so that both drivers and pedestrians can see each other in plenty of time and, if necessary, take avoiding action to prevent an accident.

This does not apply to large groups of people on an organised walk, who should be on the left side of the road but in this situation someone should walk ahead and behind the group wearing fluorescent clothing and carrying a light to alert traffic to the group.

Only a few of the rules relating to pedestrians are enforceable under the law. These include not walking on a motorway, except in an emergency, not getting onto or holding onto a moving vehicle and not loitering on any type of road or rail crossing.

Pedestrians who are injured in a road traffic accident are likely to suffer harm such as broken bones or become permanently disabled as a result of actions, or neglect, of another road user and may well be entitled to claim from the person deemed responsible for their suffering.

Even if a walker is judged by a court as partly at fault in an accident, the driver of the vehicle concerned may well be liable to pay a percentage of compensation to the victim.
