No Win, No Fee, youclaim.co.uk

Who is the no win no fee solicitor; is he different to the lawyer or barrister?

When you first decide you would like to pursue a personal injury claim, the terminology you are likely to encounter may be overwhelming and unfamiliar. Certain terms are used whenever you read about claiming compensation and it can be confusing. Let’s take, for example, one of the first terms you will come across: no win no fee solicitor.  What is a solicitor? Is it different from a lawyer, and where do barristers fit into the equation?

Solicitor
Traditionally, solicitors dealt with any legal matters apart from actually conducting court proceedings. However, minor criminal cases tried in Magistrates’ courts and small civil cases in County Courts are usually handled by solicitors.

Lawyer
In England the label of "lawyer" refers to a broad spectrum of professionals trained in law. It includes those who practice law (giving legal advice to clients, drafting legal documents for clients, and representing clients in legal negotiations and court proceedings), such as barristers, solicitors, legal executives and licensed conveyors (property law). The term also includes those involved in law, but who do not practice it on behalf of clients; for example, judges, court clerks and legislation drafters.

In Scotland a lawyer is a member of a more specific group of people trained in law: solicitors and advocates (members of the Faculty of Advocates entitled to present cases in the supreme courts of Scotland, the High Court of Justiciary and the Court of Session); it may also include judges and law-trained support staff.

Barrister
In the past, barristers did not deal with the public directly and used to be the only member of the profession that would carry out advocacy functions (proceedings in court).  This is no longer the case. Qualified solicitor-advocates can now represent clients in the higher courts of England and Wales or Scotland. Also, in certain circumstances the public can now engage a barrister who has completed the Bar Council’s Public Access course directly, without the need for a solicitor.
