Fear of a no win, no fee compensation claim being more likely in a contemporary "compensation culture" has been cited as one of the reasons that people today are more risk-averse.
The Health and Safety Executive performed a survey in 2005 to find out if people did perceive an increase in risk-aversion, which showed that they did. There was also an assumption that the compensation culture has grown, and that this is a reason for the increase in such newspaper headlines as conkers being banned.
However, if the growth in compensation culture is one of the reasons for the increase in risk-averse behaviour, it is a reason without foundations; government figures show that personal injury claims have been fairly steady since the turn of the millennium, and were, in fact, a little lower in 2007/8 than in 2000/01.
The Institute of Occupational Safety and Health frequently tries to combat the perception that health and safety is responsible for councils and companies removing things like climbing frames and Devon's last 'clam bridge'. If reports on this latter piece of news are anything to go by, they have work to do yet.
A 2006 government report exonerated risk management as having responsibility for this, laying the responsibility on "complex causes, including advertising by claims management companies, selective media reporting, a lack of information about how the law works, and on occasion, a lack of common sense amongst those who implement health and safety."
