Residents of Fleetwood, Lancashire campaigned for nearly a decade regarding life-blighting smells emitting from United Utilities' Jameson Road sewage treatment plant without redress. However, in October 2008, they were offered a legal lifeline when no win no fee solicitors told residents they were prepared to take the case to court.
Wyre Council commissioned an investigation into the Jameson Road plant carried out by Entec UK, environmental and engineering consultants, between February and September 2007. Published in November 2007, the report concluded, amongst other things, that, "[the wastewater treatment plant] is identified as the main significant source of the odours which have been giving rise to elevated H2S (hydrogen sulphide) concentrations in parts of Fleetwood and causing annoyance amongst and complaints from local residents."
The report also made reference to several areas of practice and maintenance issues on the site that were not acceptable and recommended extensive remedial action.
United Utilities continued to promise investment to improve wastewater treatment at the plant, but local residents were continually subjected to bad odours that represented a distinctly unpleasant backdrop to their everyday lives.
In September 2007, Ron Allen of the Resident's Action Group, spoke of the no win no fee litigation to the Blackpool Gazette in, saying, "The lawyers would be acting on behalf of the Residents' Action Group but they would take each case individually, trying to get compensation for individual residents.
"At the end of the day they could be making 10,000 claims."
In the summer of 2008, after continuing complaints from local residents, the Environment Agency carried out an unannounced spot check of the plant and found operational breaches of the recommendations included in the action plan.
And in October 2008, a spokesperson for the Fleetwood Residents Action Group no win, no fee solicitors said, "We are advancing matters and we are looking to investigate it on behalf of local residents. Based on evidence we have seen, it is worth investigating further."
