How the Ombudsman watches those who watch no win, no fee solicitors

Here at YouClaim, we always strive to ensure that our no win, no fee solicitors meet their clients' needs in a fully professional manner. And, under UK personal injury law, there are layers of safeguards that are intended to add weight to our insistence on meeting claimants' needs.

We will only use lawyers from legal firms governed by the Solicitors Regulation Authority, as part of our commitment to quality in our compensation claims. That commitment is backed up by the SRA's sister agency, the Legal Complaints Service, which deals with situations where clients have a complaint about the services they have receive - but it doesn't stop there. That agency, in turn, has an ombudsman to watch over its activities.

The Legal Services Ombudsman for England and Wales is a position established in the Courts and Legal Services Act 1990, which is currently held by Zahida Manzoor CBE. Should a claimant complain about their treatment by the Legal Complaints Service, she will examine that treatment and check that all relevant facts were thoroughly and efficiently considered, that they led to a reasonable and rationally explained conclusion, and any outcome was appropriate.

Should she conclude that this is not the case, she may demand that the investigation is re-done, criticise the investigating body, or award compensation to you for distress or inconvenience caused.

The 2007-8 period saw the Ombudsman make reports in nearly 2000 cases - not all of which are personal injury cases, as she also oversees the professional bodies of barristers, conveyancers and legal executives - of which a little more than a quarter involved a finding against the professional body.
