Typically, a no win, no fee solicitor will choose his or her particular career path because of a desire to secure justice and compensation for people who find themselves in difficulty, whether emotionally, physically or financially, through the negligent actions of another party.
It is interesting to compare the prevalent media attitudes towards no win, no fee solicitors with those that once existed towards legal aid solicitors. Despite the fact that the former have only come into widespread existence to fill a vacuum left by the near-total demise of the latter, it seems they receive a markedly less friendly press.
One example of this hostility would be the outcry of 2008 over the perceived avarice of solicitors representing clients in medical negligence claims. This came after it was revealed that the NHS Litigation Authority pays out some £90 million in legal fees to solicitors handling such cases.
Steve Walker, chief executive of the NHSLA, comments, "Solicitors are not doing anything illegal, but it is pretty unattractive that these fees are being charged.
"There is no reason why they should be vastly different from what we pay our own legal teams, but they are.
"Their argument is that they have a higher mark-up because there is a risk they will end up with nothing, but in reality they cherry-pick the cases they are most likely to win."
However, many within the profession responded to the accusation by countering that the fees only represent what is necessary to provide a level of service worthy of those patients who have suffered negligence. And while the cases that are most likely to be taken on are generally those with the best chance of success, it also follows that they are likely to be the most deserving.
A solicitor from law firm Irwin Mitchell explains some of the complexities behind the system, "We do not cherry-pick cases. Of course, we take on the ones we think we can win, but we also take on other ones that are more risky.
"On top of this, cases are becoming more complex.
"People are living longer so working out the arrangements needed to care for people who have been permanently harmed is harder.
"It means we have to spend more time on them consulting with a whole range of financial advisers and medical experts."
