Medical misdiagnoses are a grave concern for health service patients and they constitute a large proportion of the cases that no win, no fee solicitors deal with.
For patients who are told they are fine and later discover a life-threatening problem was missed, it can be a frightening and disturbing situation.
In 2009, a case came to light where an amateur showjumper, who had landed on her head after falling from her horse, was discharged from hospital after a junior doctor checked her X-rays and concluded that her spine injury was a compression injury when in fact her neck had been broken.
The horse enthusiast told the Daily Mail that she had been riding over fences, but when her horse bucked she came off and landed on her head.
In A&E the rider was allegedly told by a junior doctor that she had compounded her spine and that she would suffer pain for three or four days. He then removed the head block and neck brace that she had been in for seven hours since the accident.
She said, "I explained to him at the time that I heard a crack and pointed out where - above my shoulders at the base of my neck, but he didn't pick it up in the X-ray."
Six weeks later she was still suffering severe pain from the neck injury and was advised by a physiotherapist to seek a further consultation. When she contacted the hospital in Colchester, she was once again told that there was no abnormality in the bones. Eventually, her doctor referred her back to the General Hospital where it was finally discovered that her neck had in fact been broken.
Specialists at Queen's Hospital, Romford in Essex investigated the injury and the 34-year-old woman was told the bones had already started to fuse. She was offered a risky operation to correct the damage, but she decided against it.
Having walked around for two months with a broken neck the mother-of-one said that when she finally realised the severity of the spine injury she was "terrified".
'It's pretty horrible that to think at any point I could have twisted badly or been jolted and it would have broken and I could have been paralysed or dead.
'It's really scary, I now have a copy of my X-rays and when you see it in the cold light of day it's quite alarming."
The misdiagnosed patient did not initially intend to contact a no win, no fee solicitor with regard to making a compensation claim, but did intend to formally complain to the hospital and to request that all spine injuries be treated by senior physicians in the future.
