The Control of Vibration at Work Regulations 2005 require employers to fully assess the risk to workers from exposure to vibration at work and in this case it was clear that sufficient precautions to protect the engineering worker were not put in place.
Interestingly, the employee continued working for the same engineering company, but in a different capacity which did not involve the use of vibrating tools or machinery.
