Contradictions in no win, no fee complaints


It must be admitted that lawyers working under a conditional fee agreement - the official term for a no win, no fee arrangement - may face a certain amount of resistance from the public; the fact that the phrase 'compensation culture' exists is proof enough of this.

However, the reasons for this resistance should be examined, and at least one personal injury lawyer has pointed out that there is a disparity between two of the main arguments against the use of no win, no fee solicitors.

One argument is that the number of claims brought over trivial matters that have no chance of succeeding has been increased by greedy personal injury solicitors and their clients, as there is no loss to be worried about if the case is lost. The other is that fearful no win, no fee solicitors resist taking on cases as they are only to be paid in the cases that are won for their clients.

Given such a contradiction at the heart of the case, it is amazing that the belief still stands; and this is without the facts on which the case is based being examined. The statistics regarding the number of frivolous cases brought to trial, or the number of winnable cases rejected for being too difficult simply do not support the case either.
