Critics of no win no fee compensation claims often use the term "compensation culture" to infer a society, fuelled by greed, preying on the system in order to earn a quick buck. Allegations by the Local Government Agency (LGA) that personal injury claims clog up the system, and prevent councils from carrying out necessary repair work to roads, for instance, are not uncommon.
An LGA spokesman said of reports that Local councils in England and Wales paid £53m to motorists in 2007, said, "These figures show the extent to which our efforts are being hampered by the compensation culture that exists nowadays. Since no-win, no-fee was introduced, almost all councils have seen an increase in compensation claims."
Paul Marsh, president of The Law Society said, "People have to exercise common sense about the risks inherent in day-to-day life, but it is a fundamental principle that people should be able to obtain compensation when they suffer genuine injury because of the wrongdoing or negligence of others."
The Law Society states that solicitors are bound by regulations to ensure they are only able to pursue cases which have a "reasonable chance" of positive outcome.
A spokesperson for The Association of Personal Injury Lawyers commented that if roads and public buildings were maintained and serviced correctly then the risk of personal injury litigation would be minimal.
The spokesperson added, "A compensation claim will be subject to rigorous investigation and will only succeed when negligence can be proved. Although many people are becoming aware of their rights, there are still many more who do not pursue compensation for their injuries. "The easiest way to stop people claiming is to stop the negligence which causes the injuries in the first place."
A personal injury lawyer answers the critics by saying, "This accusation is not only unreasonable but completely misguided. Firstly, it must be noted that the law in this area is well developed and lawyers are generally able to tell which claims will fall at the first hurdle. "The result is spurious claims do not proceed. I would be astonished if the compensation was not paid out for good reason following thorough analysis by Local Authorities."
