Before the advent of no win no fee claims, access to justice was generally only available to the wealthy. Some cases could be conducted using Legal Aid, but not all claims could be undertaken using this funding method, and only the very poorest members of society would qualify for Government help in bringing a case to court.
So, many victims of negligence, especially those on modest incomes, could not afford the risk of losing a court case in order to gain compensation, and the whole system of access to justice was anything but equal.
However, various law changes and the introduction of the Conditional Fee Agreement saw the rise of the "no win, no fee claim" and allowed people from all walks of life to seek justice through the civil courts if they had been injured or harmed due to another party's negligent actions.
