No win, no fee claims and working as a volunteer


Generally speaking, voluntary workers are not considered to be employees and as such don't receive the same health and safety protection as official employees – however, this does not mean that volunteers are unprotected. In fact, volunteers may make a successful no win, no fee claim in the event they suffer injury while working in voluntary capacity.

Health and safety law and voluntary workers
The Health and Safety at Work Act is designed to protect employees and as such has little scope for either regulation or enforcement when it comes to purely voluntary activities.

However, as the act requires employers to protect the health and safety of members of the public, they are in effect "duty-holders" who owe a duty of care to all visitors, including customers, clients and volunteers.

Civil law
All voluntary organisations owe volunteer workers a common law duty of care and, as such, if a voluntary worker suffers personal injury while working for a purely voluntary organisation, he or she may be able to pursue a no win, no fee claim through the civil courts.

For any such claim to be successful, it will be necessary for the claimant's personal injury lawyer to prove that the defendant owed a duty of care and that was breached, causing financial loss and personal injury.
