No win, no fee claims in the construction industry and the tower crane register

The pursuit of no win no fee cases in the construction industry was greatly aided in January 2009 when a two year campaign for the creation of a tower crane register in the UK finally lead to the Health and Safety Executive (HSE) agreeing to initiate the list.

In 2007, after a spate of serious crane accidents on construction sites, a Safer Skyline campaign was instigated by Building magazine, calling for a list of all checks on tower cranes in the UK to be kept and to be made publicly accessible.

Secretary of the Battersea Crane Disaster Action Group, Lilliana Alexa, lost her son after a construction accident in 2006. She said, "It is imperative to have this security measure in place. After the crane collapse at Forest Hill [in south London] in December 2007, it took two weeks to find out who owned the crane."

In 2008 the Department of Work and Pensions (DWP) select committee backed the campaign to bring in a crane register. However, it was widely reported in the same year that the HSE were refusing to yield to the calls as the list would involve "too much paperwork".

The decision in favour of the tower crane register was finally made at an HSE board meeting on Wednesday 28th January 2009, where it was said that the safety body "must be seen to be responding to public demand".

The safety executive's chair, Judith Hacket, also said that initially the register would be voluntary "with a view to making it a statutory instrument once we know what makes sense and makes value."

Alexa said, "This register should be statutory straight away, but this is a good step."

It was stated that the register would be run by the HSE's Health and Safety Laboratory and the board's recommendation would be sent to DWP secretary James Purnell. A decision on whether or not the list will be made available to the public had not been made.
