Laser treatment and no win no fee compensation claims

Since the proposed deregulation, surgeons and doctors have spoken publicly about the associated risks of unscrupulous practitioners who have the potential to cause substantial pain and distress when using laser treatment for the removal of scars, blemishes and hair.

Laser treatment in beauty salons has previously been regulated by the Healthcare Commission, but the Department of Health (DoH) recommend that this regulation be removed.

DoH spokespeople suggest the risk of deregulation "is not proportionate to the risk of harm to patients".

APIL, speaking on behalf of personal injury lawyers, suggest that this now puts the onus on the customer to investigate the skills and qualifications of the treatment provider. Medical professionals are gravely concerned about the emergence of 'cowboy' treatment practitioners.

Denise Kitchener, Chief Executive of APIL said, "Laser treatment can be a dangerous procedure and if it is carried out by someone unqualified and inexperienced, the results can be devastating. We see first hand the kind of injuries caused when the treatment goes wrong not only can the actual process be excruciatingly painful if it's not administered correctly, it can cause terrible burns and scarring."
Currently, customers can go to a salon or treatment centre registered with the Healthcare Commission, but in a deregulated climate there is no way for people to know if they are choosing a reputable or rogue treatment provider.
It is estimated that there are approximately 3,000 laser treatment practitioners, currently unregistered, operating around the country. If deregulation goes ahead the number of laser treatment personal injury compensation claims is likely to greatly increase, as these unqualified operators will become as legitimate as those who are skilled and trained.
