Possible changes to no win, no fee services in Scotland

In 2008 the Office of Fair Trading received a complaint relating to the provision of legal services in Scotland. It suggested that the choice of service was limited and that legal services, including those provided by no win, no fee personal injury solicitors, could be provided to consumers by multi-disciplinary partnerships that would allow organisations such as banks and supermarkets to join the legal services market.

The Scottish Government responded to the complaint by publishing proposals suggesting that such organisations would have to meet the criteria of a "fit to own" test, including compliance with a code of conduct that would demand proof of capability, competence, financial integrity, honesty, reputation and ethics.

These Alternative Business Proposals for the legal market have already attracted criticism, with some commentators dismissing them as "Tesco Law".

Mike Dailly, a solicitor with the Govan Law Centre, is just one person who is of this view. "This is treating justice as a commodity. They are saying that access to legal services is the same type of goods and services as a tin of beans," he said. "It is going to undermine the independence of the legal profession."

However, other interested parties have greeted the proposals with more enthusiasm. Richard Henderson, president of the Law Society of Scotland, said that they were "a huge opportunity to modernise legal services and boost the potential for legal businesses to thrive both at home and internationally, while retaining high standards and promoting access to justice".

While Justice Secretary Kenny MacAskill commented that they represented "a once-in-a-generation opportunity to create a more flexible and modern regulatory framework for Scotland's legal services."

Others also believe that the proposals would enable clearer regulation of the no win, no fee litigation market in Scotland.
