APIL, an association whose membership includes many no win, no fee solicitors who deal with accident injury cases, released a warning about laser eye surgery in early 2009 to the media.
The body warned that the level of regulation was not high enough, and that potential patients should be aware that investigating the qualifications and records of the doctors offering this surgery was the patient's responsibility
APIL's view is that this is "shocking", and that it creates a huge disparity in the levels of care and treatment offered in this procedure. NICE, the National Institute for Clinical Excellence, does not believe that laser eye surgery should be offered on the NHS, but has warned that it does see people suffering personal injury as a result of botched private treatments of this kind, and that, while there are skilled practitioners offering this service, the danger is from the negligent.
Attempts to change the law have failed; the Regulation of Laser Eye Surgery Bill did not make it through Parliament in 2006, and has since been taken off the list of laws to be debated. People still considering laser surgery may well be advised, therefore, to ensure that their optician's insurance is up to date.
This does not mean that doctors who offer the service can do so with impunity; they still have a duty of care to their patients, and if personal injury is caused through incompetence or negligence, it is likely that a no win, no fee compensation claim could be brought against that medical professional.
