Making a no win, no fee compensation claim the right way

A conditional fee arrangement, the technical term that covers a no win no fee compensation claim, was brought in to the UK legal system as a way of ensuring that the ability to claim damages for personal injury was open to everyone.

This is an admirable aim, in that a low income need not prevent victims of medical negligence, industrial accidents or car crashes from seeking the damages they deserve to cover costs and losses that these personal injuries cause. However, a backlash began when rich celebrities were seen to be using CFAs to cover their libel cases.

These were considered by many in the press to be an abuse of the system, although it should be considered that the press were also the defendants in many of these libel cases. Yet, as a result of these cases, a precedent began from the decision by some judges that the 'winning fee' charged by some lawyers could be excessive, and should therefore not be fully paid by the losing side.

While libel has little to do with industrial accident cases, for example, the decision means that it is now certainly in a personal injury lawyer's interest to work, as Youclaim has always done, on an efficient basis with reasonable winning fees.
