Although claimants seeking compensation on a no win, no fee basis may be protected from the costs associated with their claim, it is worth knowing a little about what these costs may be, not least because it allows the claimant to check with his or her personal injury lawyer whether these costs are covered, as 'no win, no fee' can cover a range of approaches.
One of the biggest charges can be the court fees. Under plans to make the court system self-funding, Government ministers have raised court fees to the level that led Lord Justice Jackson, a Lord Justice of Appeal of the Court of Appeal of England and Wales, to challenge the increases. Jackson's 2009 report into the UK legal system found that the increases were substantially above the rate of inflation, and were contributing to approximately 80 percent of the cost of running English and Welsh civil and family courts.
The judge argued that moving the costs from taxpayers to the compensation claimants was "wrong in principle", arguing that there was a strong and widely-held belief that the state should supply the systems for dispute resolution - i.e., the courts. The Ministry of Justice responded by saying the Government would "provide real help now to those in society who most need help and support".
These costs can amount to almost £3000, in a high-value compensation claim. Not all no win, no fee claims go all the way to court, of course, but it must be considered as a possibility when deciding whether or not to proceed with a claim. As such, it is worth checking with a personal injury lawyer that the costs arising in a case will be covered as well as the lawyer's fees under your conditional fee arrangement.
