No win no fee solicitors and NHS negligence claims

Department of Health clinical negligence compensation figures for 2007/2008 show an increase in payouts for the Bradford and Airedale district when compared with the previous year. Many of the claims were brought by no win no fee solicitors.

Bradford Teaching Hospitals NHS Trust (including Bradford Royal Infirmary and St.Lukes) paid out £4.19m in 2007/08, Airedale NHS Trust had to pay compensation of £3.5m, and
Bradford and Airedale PCT (Primary Care Trust) paid out £66,300. A total of £7,775,300 in compensation awards were paid out in 2007/2008, compared with £5.15m in the previous year.

Neighbouring trusts paid out:

  • Calderdale and Huddersfield NHS Foundation Trust - £3.9m
  • Leeds PCT - £3,500
  • North Yorkshire and York - £6,350
  • Mid Yorkshire (covering Dewsbury) - £5.5m

National figures showed an increase of £13m in payouts in 2007/08, form £345m in 2006/07 to £358m.

The Chief Executive of the NHS Litigation Authority said, "The number of people making claims has remained fairly static. The amount of money has gone up because judicial inflation is much higher than normal inflation.

"Figures can also be massively distorted by two or three very high-value claims. These are often settled many years after the event, and they even out over time. People talk about compensation culture but that does not exist in the NHS. We do not see fraudulent claims."

Politicians spoke out about how the NHS had a primary duty of care to keep patients safe in the first instance.

Liberal Democrat shadow health spokesman Norman Lamb said, "This is a massive challenge for the NHS. We are living in an increasingly litigious society. These payouts are taking money away from patient care. There must be a focus on establishing systems that keep patients safe."

Shadow Health Secretary Andrew Lansley added, "Unfortunately the NHS does face escalating costs from lawsuits. The number of claims hasn't increased, but the costs have. This is in part because too often people who feel that staff have been negligent have to go to court using no win no fee."
