Amputation malt factory faced with £3k fine

A work accident in Malton that led to a malt factory worker having his leg amputated has resulted in the company being fined £3000.

This is a case brought under Health and Safety legislation, as the worker - and all his colleagues - were held to have not been sufficiently trained on a piece of machinery to avoid an accident at work while using it.

In this case, the worker had stood on a grille covering a rapidly moving conveyor which had not been designed to carry human weight. The grille broke, and after a short fall, the worker's leg was dragged into the machinery.

He managed to extricate the leg, and crawl to the control room, 60 feet away. He was then taken to Scarborough general hospital, where his leg was amputated above the knee.

The magistrates court found that none of the workers had been warned that this grille was not designed to bear weight. Further safety steps have since been taken, and the mitigating lawyer said "There is profound regret over the accident involving [the worker] and the injuries he sustained. He has been with the business since 1993 and remains a valued member of the workforce.

"The company has done all it can to support [the personal injury victim] since the accident."

This decision may mean that the worker is able to begin a personal injury compensation claim over the work accident.
