Fallen train driver wins £6k for torn ligaments

A train driver's personal injury claim has been settled at £6,000 with help from his union ASLEF.

The driver was stepping from his train to the platform at Ilkley railway station when he trod on what he believes to have been a sandwich bag, causing him to slip and fall. After a week trying to work through the resulting discomfort, he went to hospital to discover he had torn ligaments and deep muscle damage.

The driver, from Selby, said "It sounds like a minor thing, rubbish not being cleared up but it had major repercussions for me.

"That pain is still there now. It's always in the background and I've just had to learn to live with it.

"I had quite a bit of time off work and even now I still have to take painkillers and can only walk short distances."

A spokesperson from ASLEF's personal injury solicitors said "There are clear guidelines which spell out the steps that should be taken by employers."

The train company claimed to be following these guidelines, saying, "We have a comprehensive cleaning programme for our trains and stations, and we work with all our employees to prevent an accident at work."
