Guilty pleas heard in fatal flying artwork trial


Following an art accident in which two North East women suffered fatal accident injury, the council and art promotion company responsible for the inflatable artwork have admitted being in breach of the Health and Safety at Work Act.

The artist who created the large inflatable maze, which was intended to immerse visitors in a visual and aural aesthetic experience, denies manslaughter and breach of the same Act.

The incident occurred in 2006 when the maze became detached from its moorings in strong wind. The artwork soared into the air before colliding with a CCTV pole, in which, in addition to the two deaths, thirteen other people suffered personal injury, including a three-year-old.

Local police and the Health and Safety Executive instantly began investigating the accident, and laid charges against the council, company and artist earlier this year. The council and arts company will be sentenced at the close of the artist's trial, which is to be heard in late January. The results of these cases may be significant for any no win, no fee compensation claims that are brought as a result of an accident or an injury suffered in the artwork.
