Medical reports to be disclosed

No win, no fee lawyers representing the workplace injury claim of a former public house worker have been told that they must disclose all expert medical reports relating to the claimant's injuries.

The ruling was made by the Court of Appeal after the defendant in the case asked that details of the claimant's medical report be revealed to all parties.

It is understood that no win, no fee lawyers had planned to use a medical report prepared by three expert orthopaedic surgeons but had later switched to one prepared by a non-court-approved expert.

The judge commented, "Expert shopping is undesirable and, wherever possible, the court will use its powers to prevent it."

No win, no fee lawyers representing the accident at work claim had sought to argue that medical reports prepared before the commencement of proceedings should be privileged, without any obligation to disclose to the opponent.
