Head in hands outcome for claimant
The motorcycle crash claim of a 58-year-old man who suffered multiple personal injury in a collision with a BMW has had his compensation claim rejected by London's Court of Appeal.
London's Court of Appeal heard that the motorcycle crash claim related to a December 2004 incident in which the claimant's 400cc motorbike had collided with a BMW at a junction in Bath.
Although accepting that since his client was partly responsible for the incident he was not entitled to 100 percent compensation, the claimant's personal injury lawyer still hoped to win a 50 percent settlement for serious injuries that have led to a long-term reduction in earnings.
However, judges at the Court of Appeal ruled that the BMW driver had not been in breach of the Highway Code and "was doing nothing but going straight ahead".
They said that they had "no hesitation in rejecting submissions that [the driver] ought not to have overtaken."
It is reported that on hearing of the failure of his motorcycle crash claim, the claimant "held his head in his hands".
