Brighton motorcycle accident found to be fire engine's fault

A Brighton man involved in a motorcycle accident that left him in intensive care has won the right to pursue a compensation claim for the personal injury suffered when a fire engine crashed into his bike.

The accident occurred on Friday 13 August, 2004. The motorcycle injury suffered by the biker included ten broken bones and nerve damage, and caused the man to spend several days in intensive care. It was more than three years before he was able to return to work as a legal advisor.

A court heard how the fire engine, while travelling on an emergency call, moved across the path of the motorcyclist, and decided to overturn a previous decision that the motorcycle accident had been the fault of the rider. The judge then ruled that the firefighter at the wheel of the fire engine caused the road traffic accident by moving across the biker's path when he could not have known if it was safe to do so.

Reports state that the man is now waiting to see if the fire service will make an offer of settlement, or if he will need to engage the services of a personal injury solicitor to pursue a compensation claim over this motorcycle accident.
