Claims over dismissed consultant
A locum consultant pathologist working at an NHS hospital in Wales has had his contract terminated after it emerged that as many as 34 of his former patients may have grounds to claim medical negligence compensation over his substandard care.
Freedom of Information Act disclosures have revealed that two of his patients have already decided to employ personal injury lawyers to commence medical negligence compensation claim proceedings.
One of these, a 30-year-old mother from Llandybie, is doing so because she was incorrectly led to believe that she was cancer-free after the consultant performed tests on her then failed to contact her to inform her she had malignant melanoma.
The mother-of-three told local press, "I am going ahead with the claim and it's all going through my solicitor. "It has caused me a lot of distress - they are just keeping an eye on everything."
When asked to comment on the medical negligence compensation claim, a hospital spokesperson said, "We are still in the investigation stage at the moment. "The claim will be pursued, and we are hoping it will not be necessary to issue court proceedings. "It's just at the first hurdle. The admittance of the mistake was made and we have to show what injury the client has suffered as a result of that mistake."
"At present the trust cannot say, at this stage, whether either of the claims will result in the trust incurring any legal liability for paying compensation."
