A brief guide to industrial injury compensation for firefighters

Fire-fighters who suffer health problems caused by work may be entitled to industrial injury compensation as part of the Industrial Injuries Scheme.

Many potential hazards can arise for fire-fighters during their employment including physical arduous work, radiation, heat, and exposure to potential carcinogens as products of combustion in fires and explosions.

To claim under the scheme, a range of circumstances must be met. These are set out in a schedule. Once the conditions are met, the Industrial Injuries Advisory Council (IIAC) can recommend prescription of a disease.

Any fire-fighter classed as an "insured earner" and identified as suffering from a prescribed industrial disease can receive Industrial Injury Benefit, a no-fault compensation award.

Eligibility for industrial injury compensation

To be eligible for the compensation, various requirements have to be satisfied.

Firstly, "some meaningful degree of disability" must be caused by the disease which is recognised as long-lasting and serious.

Definition and diagnosis of the disease must be achieved confidently and without requiring claimants to be subject to invasive or expensive procedures. Also, an objective diagnosis is preferred independent of the claimant.
