Boy wins payout for negligence

Delayed diagnosis compensation has been paid to a three-year-old boy who lost his eye, possibly as a result of an administrative failure by an NHS hospital in Northampton.

The boy's parents decided to instruct medical negligence lawyers to pursue a delayed diagnosis compensation claim against the hospital after it became clear that the hospital's "misplacing" of the boy's medical records led to a three-month delay in diagnosis.

By the time the boy's appointment was booked a cancerous tumour had spread in his right eye.

His mother commented,"My son might not have lost his eye if he had been treated and diagnosed more quickly, after the optician's concern."

The family's personal injury lawyer explained that the parent's decision to pursue litigation was "taken not only to protect the interests of her son, but also to gain answers as to how such a fundamental error could have happened, in an attempt to safeguard other families from suffering the same fate".

He continued, "There was clearly a need to urgently investigate further and the hospital has accepted that in normal circumstances, [the boy] should have been seen within two weeks of being referred.

"Sadly, the delay of almost three months in calling him for an appointment had catastrophic consequences."

The boy's settlement, which is believed to be a five-figure sum, will be held in trust until he comes of age.
