This requirement for employers' liability insurance exists in all of England, Scotland and Wales and even for UK-based offshore work such as that which is undertaken on oil rigs.
Furthermore, although employers are legally required to be insured for at least £5 million, the Health and Safety Executive advises most employers to purchase cover to the level of at least £10 million. This is because catastrophic injuries, such as paralysing spinal injuries or serious brain injuries, are often compensated with high value settlements which include components for loss of future earnings and the cost of future care.
Where liability cover is absent
Unfortunately, because there is no insurers' bureau to provide cover for the victims of accidents caused by the negligence of uninsured employers, those who suffer a back injury in an uninsured workplace setting may be unable to claim the compensation they deserve.
