A birth injury compensation claim has been filed against the NHS by the parents of an eight-year-old girl from Gwent who was left permanently disabled after suffering oxygen starvation during delivery.
The High Court writ against Aneurin Bevan Health Board states that if the baby had been delivered one hour earlier than she was on June 22nd 2002, she would not now be suffering from severe cerebral palsy, epilepsy and a host of other physical difficulties.
Personal injury solicitors for the family allege a number of medical negligence issues including, failure to; recognise hyperstimulation, recognise a "pathologically abnormal" heart rate, restart heart monitoring, call for obstetric assistance during various stages of labour and prepare adequately for assisted birth.
If successful the birth injury compensation claim could see a substantial amount of damages payable in respect of a range of matters; primarily in relation to the girl's lifelong care and supervision, and consequences for the family.
