Girl wins settlement for birth-related brain damage

A 14-year-old girl has succeeded in making a High Court birth injury claim against the hospital that delivered her.

Through her mother, the claimant, who suffered brain damage as a result of being deprived of oxygen during delivery, had argued that she should be awarded a birth injury claim payout on the grounds that a caesarean should have been carried out.

Although Norfolk and Norwich Hospital denied liability, after negotiations with the claimant's medical negligence lawyer it eventually agreed to settle the claim.

The girl's QC commented, "We, on our side, are satisfied that it is a fair and proper resolution of a difficult claim."

And, although the settlement was not the 100 percent compensation payout hoped for she said that "it has brought financial stability and… makes her future secure."

It is predicted that the birth injury claim settlement will eventually be worth several million pounds.
