Former United player's £4.3 million injury settlement upheld

A former Manchester United footballer who suffered a broken leg in a career-ending tackle by a Middlesbrough player has had his right to 100% compensation upheld by the Court of Appeal.

Middlesbrough Football Club had sought to challenge the original decision to award Ben Collet, a promising 18-year-old footballer with Manchester United's reserve team when the incident happened, £4.3 million pounds in damages.

However, the judges hearing the case at Manchester Civil Courts ruled that the sums awarded should be considered fair 100% compensation for "lost career".

Lady Justice Smith commented, "The judge has put into the balance the possibility that the respondent might have done better than she had predicted.

"She was entitled to take that view."

The personal injury solicitor who represented the former footballer's claim explained why his client was satisfied with the 100% compensation decision. "When Ben was awarded £4.5 million in damages last year, it reflected the extent of his potential as a professional footballer before his career was effectively ended by a tackle some six years ago," he said.

"Clearly, Ben would have preferred to have earned this sum through a career as a professional footballer, but is naturally delighted that the damages awarded remain completely intact and that the Appeal has been dismissed in its entirety.  He would like to thank everyone concerned for their messages of support and would ask that his privacy continues to be respected."
