Work-induced hearing loss and the "acoustic pain" device

You may have heard of the "mosquito" a device that emits a high-pitched, high-frequency noise in order to drive away "undesirable" young people from certain shops and public places. However, although the device has never been implicated in any claim for work-induced hearing loss, some have expressed concerns that it could potentially have damaging effects on the hearing of young children and babies.

It is clear though that by fulfilling its aim of inducing "acoustic pain" in young people, especially gang members and anti-social youths, it certainly does induce symptoms of a kind that might be deemed a temporary personal injury.

However, it is unlikely that any person would be able to mount a successful compensation claim on these grounds.

Instead, say many, the legal grey area of these devices relates to the way they may or may not impinge on human rights. A report by the committee on culture, science and education at the Council of Europe has described the mosquito as "highly offensive" and questioned whether it might breach certain human rights such as the rights of children and the right to a private life.

So far, the device has been set up at 3,500 UK locations. There have been no reports of the mosquito causing any hearing damage to members of the public, nor indeed any work-induced hearing loss in those who work in close proximity to it.

A spokesperson from no win, no fee deafness compensation specialist YouClaim comments, "Although it may not present a threat to the hearing of workers, this device does help highlight the need for employers and regulatory bodies to stay attuned to the hearing hazards presented by emerging technologies."
