Arm injury leads to medical negligence claim

We're lucky in this day and age that if we're struck down with an illness or receive personal injuries in an accident, medical advances mean that we've got a better than ever chance of making a full recovery.

Today's technology and the excellent training that medical staff receive gives us extra peace of mind that when we're admitted to hospital we can put our trust in the professionals and look forward to a successful procedure.

But despite all the exams, all the training and all the experience, some of those responsible for providing medical care do make mistakes and sometimes the consequences can be devastating.

Here at YouClaim we've helped thousands of people who have been affected by cases of medical negligence. Our panel of expert no win, no fee personal injury solicitors have pursued their compensation claims and every single one of them has kept 100% of any damages that have been awarded.

Below is just one example of the many people who we've helped to make successful medical negligence claims.

Playground fall results in medical negligence
A mother from Leeds contacted YouClaim after her 10-year-old son was involved in a particularly distressing case of medical negligence. The boy had been playing football in the playground on his school lunchbreak when he fell and landed awkwardly on his arm. He was in such pain that his mother was called to take him home.

She collected him and decided to take him to A&E to get his arm checked out. The nurses at the hospital examined the youngster's arm and, concluding that is was just badly bruised, sent him home with orders to rest it.

Four days later, however, the 10-year-old was still in excruciating pain and his arm was badly swollen so his mother took him back to the hospital. His personal injury was examined once again but this time it was discovered that his arm was actually broken.

His damaged limb was put into plaster but, upon removal of the cast sometime later, it was found that the four days between the bone being broken and the injury being properly recognised had resulted in extensive medical problems.

The bone had already started to fuse incorrectly before the injury was correctly diagnosed and so the cast had simply compounded the problem. When it was removed, the arm was found to be deformed and the only option was to re-break and re-set the bone.

Not surprisingly, this horrendous case of medical negligence was hugely traumatic for the young boy and he suffered much unnecessary pain and trauma because of a medical professional's carelessness.

Pursuing a medical negligence claim
His mother was disgusted with the way her son had been treated and contacted YouClaim to enquire about the possibility of making a compensation claim against the hospital.

She spoke to one of experienced claims handlers who talked her through the personal injury compensation claim process and answered all of her questions. She was told about our hassle-free no win, no fee service as well as about how she would be able to keep 100% of any damages that were awarded.

Impressed, she decided to go ahead with the medical negligence claim and we ensured that a personal injury solicitor who specialised in this type of claim handled the case.

The hospital trust were notified of the compensation claim that was being made against them and decided not to contest the fact that their staff had been negligent. As a result, a court case was not necessary and they offered the boy damages of nearly 5,000.

His personal injury solicitors felt this was not enough for a medical negligence claim of this type and turned down the offer. Still unwilling to go to court and face the negative publicity that would result, the hospital trust came back with an offer of just over 10,000 which, after discussing the matter with the boy's mother, the personal injury solicitor accepted. He didn't take a single penny of the damages for himself and the child's mother got the entire amount.
