In 2011 the Supreme Court made a landmark ruling in deciding to award mesothelioma compensation to the family of a woman who, in 2009, died at the age of 49 as a result of being exposed to asbestos while a pupil at a Welsh school in the 1970s.
Despite the fact that the level of asbestos exposure suffered by the woman was described as "low", the court decided to uphold an earlier Appeal Court judgement and award the woman's family £240,000 in mesothelioma compensation.
Both personal injury solicitors and schools groups hailed the judgement as an important precedent, claiming it could lead to thousands more deserving people receiving compensation for supposedly "low level" exposure.
The general secretary of the National Union of Teachers gave voice to this hope. "This case is of great significance since it is the first time that a former pupil has been awarded compensation for asbestos exposure which took place whilst at school," he said.
"We hope it will act as a wake up call for local authorities and other employers to improve asbestos management in schools.
Despite the fact that there is no record of pupil asbestos deaths, because children are more vulnerable to asbestos exposure than adults it is likely that the pupil asbestos-related death rate is significantly higher than that of teachers.
