Fortunately, the British legal system is very clear on the area of mesothelioma compensation.
This is best illustrated by the 2011 joint cases of Sienkiewicz v Greif and Knowsley Metropolitan Borough Council v Willmore in which a judge ruled that, unlike claimants for other industrial diseases, who must prove that exposure more than doubled risk of illness, claimants for mesothelioma compensation need only prove that exposure to asbestos "materially" increased their risk of developing illness.
This ruling is still considered a landmark in establishing that there is no level of asbestos exposure which can be considered a "safe threshold".
Indeed, in the case of Knowsley Metropolitan Borough Council v Willmore, the claimant's no win, no fee lawyer successfully argued that "mesothelioma can occur after low level asbestos exposure and there is no threshold dose of asbestos below which there is no risk".
This is a position supported by official government advice, which states, "The risk will be lower, the lower the exposure, but "safe" thresholds are not identifiable."
As such, claimants who have suffered exposure in relatively "low level exposure" environments such as schools or offices may be able to receive compensation and it is recommended that they discuss their circumstances with an experience asbestos lawyer.
