However, it is still possible for civilians who were employed by the MoD pre-1987 to proceed with claims as the organisation never possessed immunity from claims mounted by civilians.

For a long time there has been talk of settling this disparity, possibly at the European Court of Human Rights, but for most, it is likely that any change would be too late.
