X-ray negligence can be serious and have long-lasting and painful consequences. However, incidents of X-ray negligence are rarely as serious as those which involve misdiagnosis of injuries to the neck and spinal cord – and in many such cases those affected may decide to instruct a medical negligence solicitor.
2010 negligence case
In 2010 medical negligence solicitors secured a £105,000 injury compensation settlement for a claimant who suffered misdiagnosis of a fractured L1 vertebrae.
The misdiagnosis led to the man's vertebrae fusing, which caused him pain, discomfort, distorted posture and the need for an osteotomy.
If the man had received an accurate diagnosis he would have been given a back brace and in all probability would have avoided any need for surgery.
2011 negligence case
In 2011 a six-figure medical negligence misdiagnosis compensation payout was paid to a man who suffered a misdiagnosis in 2000 at Tameside Hospital.
The claimant, who was only 12 at the time, attended the hospital complaining of various symptoms in his neck. He was given an X-ray and later discharged with a neck collar.
However, following four years of pain and numbness, another inspection of the 2000 X-ray brought to light serious spinal damage. Following this revelation, further tests and X-rays led to a diagnosis of spinal cord compression.
As a result of these diagnostic failures, the claimant developed from persistent pain, impaired mobility and difficulty balancing.
It is likely that an early diagnosis of his spinal injury would have resulted in prompt surgery and, in all likelihood, no further problems.
"I want to get on with my life and put the past behind me. But I do feel it is important to see that lessons have been learnt from the mistakes that were made in my diagnosis. I wouldn't want anyone else or their families to go through what we've had to go through," commented the claimant.
