When it comes to medical negligence, it could be argued that medical professionals do not do themselves or their patients any favours by ignoring the warning signs. There are so many situations where doctors fail to take their patients' concerns about their health seriously and don't carry out the appropriate tests to make sure that they are not misdiagnosing.
For example, there have been numerous cases where patients have been sent away from hospital having been told that they have just sustained bruising to a bone after they have insisted that their personal injury feels far worse than just bruising. It has then come to light weeks later that they had in fact suffered a fracture and that they require medical attention.
One such incident that could have resulted in medical negligence in two stages is that of Gina, a 59-year-old woman from London who was diagnosed with breast cancer is 2000. She initially went to her GP because she felt a lump in her breast but he said that it was probably just a cyst and sent her away.
Gina didn't feel right about the diagnosis as the lump was causing her pain and she returned to the doctor's surgery where he again dismissed her concerns. She had to go back a third time before the GP agreed to send her for tests to see if her lump was cancerous and it turned out that it was. She was told that the cancer had been caught just in time and that it could have spread a lot further had it been left any longer, which was a relief for Gina. She also felt angry that she had to be so persistent with her GP but after a lumpectomy and a course of radiotherapy Gina's cancer was no more.
After 5 years in complete remission, Gina was sent a letter to mark the occasion. This was great news but two years later Gina began to feel a familiar discomfort in her breasts. She suspected that this tenderness may be a result of the hard scar tissue that she had after her surgery but, nevertheless, she thought that it should be checked out.
She looked in her diary and saw that her aftercare check-up was due in two months so she contacted the hospital to bring forward the appointment. However, the hospital told her that they had no record of her impending appointment and she was passed from department to department and nobody would book her in. About 6 weeks later, following many phone calls to her local hospital and a lot of worry Gina eventually received an appointment for a scan and was given the all-clear.
Well, you see how both Gina's dismissive GP and inefficient hospital certainly made things difficult for themselves and Gina. This time it didn't result in a medical negligence claim but this sort of behaviour that could so easily could have cost Gina's life and made a big hole in the NHS's finances.
