Woman sues for breast enlargement
In January 2006, YouClaim received a call from a young woman who had recently undergone cosmetic surgery to have a breast enlargement. She felt confident that she had carried out all the right research beforehand but the results of her surgery were shocking.
The 23-year-old had been looking forward to having the operation for years and had worked two jobs to be able to afford the procedure. She was hoping to go from a 32B Cup to a 34D Cup and had been told by her surgeon that it was a common procedure and that she should feel confident about the outcome.
However, just days after having the operation, she went back to the clinic to have her bandages removed. When she looked in the mirror she was concerned that one breast looked bigger than the other and that her left nipple was slightly higher than her right one. The nurse said that it was probably due to the swelling and that with time they will both look the same.
Several months later they still weren't the same size and her boyfriend also said they looked slightly wrong in shape. She went back to the clinic but they didn't seem to listen to her and continued to say that they were still swollen.
She decided to get a second opinion from another clinic and was told that one breast implant was in fact one size smaller than the other. After having spent thousands on the procedure she sought free legal advice and came across YouClaim's website. She spoke to an advisor who reassured her that she had a claim and within a matter of days a personal injury lawyer was working on the case.
Initially the clinic did not accept liability for the medical negligence but with threat of being taken to court and having the bad press to follow, they agreed on an out-of-court settlement.
In total, the young woman was awarded £7,000 and referred to another clinic where she could have corrective surgery.
