Financial targets and medical negligence compensation in Scotland

Although a financially strong NHS is no guarantee against negligence occurring in hospitals, it is often the case that trusts with large medical negligence compensation bills are the ones struggling to meet financial targets.

Fortunately for Scotland there is evidence that health boards in the principality are becoming increasingly self-sufficient, relying less on the kinds of one-off funding schemes that make for instability and unsustainability.

But, just as with all other services in the UK, hospitals are susceptible to economic pressures, and there are concerns that a recessionary market will take its toll on the quality of service offered by the NHS.

These concerns are particularly pertinent in Scotland, which spends more on health care per head of the population than any other part of the UK. Furthermore, the NHS is Scotland's largest single employer, accounting for 155,000 of the active workforce.

Some see it as a stroke of good luck that the recessionary market in 2008 has coincided with a curb in the growth of health spending in Scotland. For example, while health spending in Scottish hospitals during the period 2004-2008 rose by approximately 33%, spending for the period 2008-2011 is earmarked to rise by only 13%.

Scotland has also been in the unique position to record marginal underspends in recent years. In 2007, this underspend came in at a healthy £24 million. It can be seen as pertinent that this is nearly the same figure as the £20 million spent on medical negligence compensation in 2006/2007.

Auditor General for Scotland Robert Black comments, "The financial performance of the NHS was good during 2007-08. The service continues its steady improvement in this area over the past few years. This is the third year in a row that the NHS has ended the year with a small underspend."
