Medical negligence compensation and examining UK psychiatric care

Although, mainly because of the instability and vulnerability of the patients involved, it is difficult to estimate how many psychiatric patients could in theory receive medical negligence compensation each year, it is clear that NHS has been criticised for providing psychiatric services that are "inadequate".

This reality is best demonstrated by figures compiled by the National Patient Safety Agency (NPSA). Alarmingly, these figures reveal that in the period 2007-2008 alone more than 1,280 patients died in "patient safety incidents in mental health settings".

During the same period, a further 913 patients are thought to have suffered serious and lasting injuries.

Paul Corry, a spokesperson with mental health charity Rethink, comments, "These figures are very disturbing and unacceptably high. Almost 1,300 deaths in a year is far too many. The NPSA data tell us that too often NHS care for mental health patients is poor."

While Norman Lamb, Liberal Democrat health spokesperson, comments, "These figures are shocking. It's a scandal that four people a day are dying while under the care of the NHS, and nearly three a day are ending up seriously harmed. It's an appalling indictment of NHS psychiatric care.

"These deaths are the result of inadequate attention and resources being given to mental health, despite the patients being among the most vulnerable and needy in the whole health system.

"There's discrimination in the system that disadvantages the mentally ill. The NHS is falling down too often in its responsibility to do whatever it can to protect such patients."

Such an outlook would seem to indicate that many of the patients affected, or their families, may have grounds for receiving medical negligence compensation.
