The medical negligence claim of 55-year-old Luke
In 2000 Luke noticed a cyst just below the knee of his left leg. Slightly concerned by it, he went to see his doctor, who immediately told him not to worry about it, saying it was benign and never likely to become cancerous.
Despite this reassurance Luke went to see his doctor again shortly after saying that he would feel happier if he had conclusive proof nothing was wrong.
Ten months later, worrying the cyst had grown, Luke returned to his doctor with the same complaint. Again his doctor told him not to worry.
Midway through 2001, Luke decided to seek a second opinion, so saw another doctor at the same practice. Again he was told to ignore the cyst and felt he was "treated like a whinging hypochondriac".
Still not satisfied, Luke booked himself in with a private consultant. Immediately, the consultant expressed concern and scheduled for a specialist to take a swab.
When the specialist confirmed that Luke did in fact have cancer, Luke was hardly surprised. Instead, he was angry that the doctors at his GP surgery had consistently avoided taking the investigative measures he had requested.
The cyst was removed, but because it had been allowed to progress. Luke also lost some muscle tissue around the calf and, as a consequence, now suffers reduced mobility.
Luke, upset at having unnecessarily lost some strength and mobility in his legs, decided to make a medical negligence claim.
Although his GP surgery at first denied liability, they eventually agreed to settle the medical negligence compensation claim out of court for a confidential sum.
