Medical negligence claim and the importance of medical information

After a medical error, a medical negligence claim can help the sufferer gain the support they need to go about their everyday lives. Medical errors during birth can be catastrophic for both mum and baby and lead to life-long disability which could require long term medical treatment and care.

Compensation claims are therefore necessary to help pay for medical equipment and any care assistance that may be required. In January 2010, a 13-year-old girl who was severely injured at birth was awarded £35.6 million in compensation from South Buckinghamshire Hospital NHS Trust. While this may seem a large amount, the amount awarded takes into account the care and support that the girl will depend upon for the rest of her life.

The girl was born with breathing difficulties and later developed fits whilst in the Special Care Baby Unit. She was later diagnosed as having spastic quadriplegic cerebral palsy which has left her with severely delayed mental development and learning difficulties. If it were not for medical negligence on the part of the doctor's responsible for the girl's mother's care, her medical complaints could have been avoided.

Doctors failed to inform the mother-to-be that due to a previous birth, which involved caesarean delivery, there was a risk of rupture of the womb should she have a subsequent labour with a vaginal delivery. If the mother had been informed, she could have opted for a second caesarean delivery which would have removed the risk of the health problems that the girl developed through the vaginal birth.

The family's personal injury solicitor commented, "The amount of money she received seems big but it is required to pay for the care and equipment she will need for the rest of her life. The award will provide security for her for the rest of her life."

Medical negligence can have lasting impact on a person's health. If you, or a loved one has suffered from medical negligence, you could be eligible to make a compensation claim for your suffering.
