Make a medical negligence compensation claim for your back pain misdiagnosis

Four in five adults will suffer from back pain at some stage in their lives. Back pain is one of the most common causes for a GP visit in Britain yet the cause of back pain can be hard to diagnose. This can lead to misdiagnosis and in the worst scenarios, medical negligence.

The spine is made up of 24 vertebrae all held together by strong elastic ligament in a column. The back is divided by doctors into five regions – the seven cervical vertebrae which make up your neck, the 12 thoracic vertebrae which form your upper back, the lumbar vertebrae which form your lower back and the Sacrum and Coccyx which make up the tail of the spine.

Most back pain is caused by damage to the lumbar region as this is the area which carries the weight of the upper body, plus any extra weight the person is carrying. It also twists and bends more than the upper part of the back making it vulnerable to strains.

While strains are the most common cause of back pain, when you seek medical advice from your doctor it is important that as much information about your condition is given to ensure that a misdiagnosis is not made and other conditions that may be causing the pain are ruled out.

In 2009 a 43-year-old -woman, left disabled after doctors misdiagnosed her spinal condition, agreed to a million-pound-settlement with two local doctors and Barking, Havering and Redbridge NHS Trust.

She had been referred to an orthopaedic surgeon in October 2002 for a believed diagnosis of Carpel Tunnel Syndrome and the former coffee shop manager was told she urgently needed to be seen by a neurologist. However, procedural failures by the hospital meant that she was not seen until nine months later after she had suffered further deterioration to her condition.

Medical experts believe that had she been operated on before May 2003 she would be much better today.
A clinical negligence lawyer who represented the woman said that, "We are pleased that this result will at least offer our client the resources to adapt her home and maintain a reasonable quality of life with the long term care she needs."
