Laser eye surgery complications can lead to medical negligence claim

Doctors and researchers have made many advances in treatments in recent decades and one for which short-sighted people are grateful is laser eye surgery but, unfortunately, complications arising from the procedure can give rise to claims of medical negligence.

These operations, which started to become easily available in the 1980s, are generally safe and simple. They involve using a laser to change the shape of the cornea, thus improving the sight, usually so that the patient no longer needs to wear glasses to correct his or her vision.

With the continuing development of the techniques and experience of the best practitioners, serious complications are rare but when they do occur they can have devastating effects.

Infectious keratitis and corneal ectasia are two of the serious conditions which may develop as a result of the treatment, both of which may require further urgent remedial treatment to save the sight of the eye.

Less serious complications or side effects of sight correction surgery can include dry eyes and problems with night vision, such as hazing, which make driving at night or being in dim conditions difficult.

As well as the possibility of medical negligence cases arising from errors during laser eye treatment, patients could have reason to make a product liability claim if they feel they have been given unreasonable expectations of the results of the procedure.

Up to 10% of patients do not see as well as they hope and have to return to the same doctor or another for further operations.

If the surgeon has not made the potential risks and outcome of the surgery completely clear to the patient at the outset, this can be the basis for liability should problems arise. Full health checks also need to be made and the presence of certain eye conditions should preclude the person from having the laser treatment.

These include kerataconus, glaucoma, people who have had other eye surgery or active infections as well as those with frequent changes in their need for sight correction, such as children whose eyes are still developing.

Many people benefit from being able to stop wearing contact lenses and spectacles after laser eye treatment but anyone thinking of having an initial consultation prior to the operation should be keenly aware of the risks and ask sufficient questions to ensure their long-term eye health.
