Medical error and negligent botox treatments

The number of cosmetic surgery patients who become the victims of medical error is of major concern to both consumer and medical safety groups.

And one of the most common of cosmetic treatment medical errors relates to the administration of botox injections.

In the first decade of the 21st century there was a boom and proliferation of botox practitioners, with more than a million treatments taking place in the UK in 2009. However, there was also an accompanying growth in the number of so-called botox "pirates" who provided treatments to patients, despite not possessing appropriate training or qualifications.

High-profile incidences of patients suffering injury and disfigurement at the hands of these practitioners together with a number of widely-publicised no win, no fee compensation payouts for negligent botox treatment, such as the £10 million that was awarded to a doctor who suffered botulism as a result of the injection, combined to create a climate which demanded an urgent response.

As such, in 2010, with the assistance and blessing of the Department for Health, the Independent Healthcare Advisory Services (IHAS) announced that it would be organizing a register of qualified and "responsible" providers.

The organisation's chair, a surgeon himself, commented, "We are appalled by the sheer volume of bad practice within the industry."

He added, "People who aren't properly trained are dangerous, potentially. Patients are very much at risk when they go to people who aren't properly clinically trained in this sort of injecting work."

However, the register was not viewed then, nor is it now, as an ideal solution. Peter Walsh, from Action against Medical Accidents, commented, "In the absence of a more robust statutory scheme to regulate the cosmetic treatment industry, which is what's really needed, we welcome this initiative taken by responsible members of the industry themselves."
