How product liability claims are affected by manuals and instructions

The law that covers product liability claims does not apply to pure information, except in the case of instructions that come with a product that features in a personal injury claim.  This means that an instruction manual or usage guide is an important piece of evidence for this kind of case.

On the one hand, a manual may be able to help the defence argument.  If a personal injury has arisen as a result of misuse of an item, and the manual warns against that particular kind of misuse, it will be harder to argue that the manufacturer has liability for a resulting accident.  If the manufacturer fails to warn against misuse, particularly where it is known to be a common misuse of the item, the defence may be weakened.

Of course, the user of the item must read those instructions.  An accidental injury that results from failing to follow instructions that have been provided is not likely to lead to a successful compensation claim.

On the other hand, a manual that fails to pass on the correct information may help a claimant's case.  Whether the instructions tell a user to perform a risky operation with the product in question, or merely fail to warn against a common misuse, they may help an accident solicitor to demonstrate liability on the part of the company.

The law also makes clear that the company responsible for the product, not the printer of the manual, is responsible for the information contained within it.
